Terms & Conditions

Welcome to Sell My Home LLC ("Company," "we," "us," "our"). These Terms & Conditions ("Terms") govern your access to and use of our websites, mobile applications, platforms, tools, and services (collectively "Services"). By using or accessing our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

1. Who We Are & What We Do

Sell My Home LLC provides tools and services to help homeowners sell real property — including:

  • AI-powered automated listing & marketing
  • Optional full-service agent support
  • Access to MLS, online showings, offers, contract generation, escrow coordination
  • Buyer tools to request showings, submit offers, etc.

Sell My Home LLC is not a law firm, tax advisor, or financial advisor. Any legal, tax, or financial decisions are your responsibility.

2. Agreement, Eligibility & Account

  • To use certain features, you may need to register, provide accurate information, and create an account.
  • You represent that you are at least 18 years old, have legal capacity, and (if listing property) have the legal authority to do so.
  • You agree to keep your account information current, and to maintain confidentiality of your credentials.

3. Use of Content, Intellectual Property, & Licenses

  • All content on Sell My Home LLC (text, graphics, logos, software, data, etc.) is owned by or licensed to the Company. You may not reproduce, distribute, modify, or display it without our prior written consent.
  • If you upload or submit content (photos, descriptions, etc.), you grant Sell My Home LLC a non-exclusive, royalty-free, worldwide license to use, adapt, display, and distribute that content for the purpose of providing Services.

4. Use of MLS Data, Listing Rules & Syndication

  • When you list your property with Sell My Home LLC, the Company may submit your listing to the Multiple Listing Service (MLS) and/or other real estate listing platforms.
  • Listings are subject to MLS rules, including but not limited to accuracy, disclosure, expiry, and removal.
  • You are responsible for providing accurate property information, disclosures, etc. Sell My Home LLC is not liable for errors or omissions in that information.

5. Fees, Commission & Payments

  • For AI-powered automated listing service, you pay 1% commission only upon a completed sale.
  • Full-service agents' fees or commission rates (if applicable) will be clearly disclosed in your listing agreement.
  • There are no upfront fees, except as otherwise expressly agreed.
  • All payments, commissions, or fees are due as specified in your agreement.

6. Listings, Offers & Transactions

  • Sell My Home LLC provides tools for you to receive offers, review them, schedule showings, and manage transactions.
  • Sell My Home LLC may facilitate some of these tasks (e.g., contracts, escrow support) via third parties (attorneys, title companies, escrow agents).
  • Acceptance of any offer is entirely your decision. Sell My Home LLC is not responsible for outcomes (price, timeline) beyond what is provided in the tools.

7. No Guarantees

  • Sell My Home LLC does not guarantee that your property will sell, or that it will sell by a certain date or at a specific price.
  • Market conditions, competition, and external factors may affect results.

8. Data, Privacy & Communications

  • We collect, use, store, and disclose user data as described in our Privacy Policy.
  • By using the Services, you consent to receiving electronic communications (emails, texts, notifications) from Sell My Home LLC.
  • If you provide photos or other property data, you represent you have all rights needed to share them.

9. Limitations of Liability & Disclaimers

  • Sell My Home LLC Services are provided "as is" and "as available," without warranties of any kind, either express or implied.
  • To the maximum extent permitted by law, Sell My Home LLC is not liable for indirect, incidental, special, or consequential damages (including lost profits or value, delay, etc.).
  • Our total liability in any case is limited to the amount you paid Sell My Home LLC for the specific Service at issue.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sell My Home LLC, its officers, directors, employees, agents, affiliates, and partners from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your breach of these Terms
  • Your violation of law or rights of others
  • Property listing content, disclosures, or any misrepresentation

11. User Conduct & Prohibited Use

You agree not to use the Services to:

  • Submit false, misleading, or fraudulent information
  • Violate any local, state, or federal law
  • Interfere with the operations of Sell My Home LLC or its network
  • Infringe on intellectual property rights
  • Transmit spam, malware, or anything unlawful

12. Termination, Suspension & Cancellation

  • Sell My Home LLC may suspend or terminate your access to Services for violations of these Terms, legal reasons, or misuse.
  • You can cancel listing or agent service per your listing agreement, subject to any obligations (e.g., notice, offers in process).
  • Some sections of these Terms survive termination (like liability, indemnification, intellectual property).

13. Dispute Resolution, Arbitration & Class Action Waiver

  • Sell My Home LLC may require binding arbitration for disputes, except where prohibited by law.
  • You may have the option to opt-out of arbitration within a specified period after accepting these Terms.
  • Disputes will be on an individual basis; no class actions unless agreed.

14. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
  • You agree to submit to the exclusive jurisdiction of courts (or arbitration) in Florida for resolution of disputes.

15. Changes to Terms

  • We may update or modify these Terms at any time. If changes are material, we will make reasonable efforts to notify you (e.g., via email or notice on the site).
  • Your continued use after the Effective Date of changes means you accept the updated Terms.

16. Additional Terms & Notices

  • Privacy Policy, Cookie Policy, and any other policies (e.g., MLS data terms, data licensing) are incorporated into these Terms by reference.
  • Any financial, real estate, or legal advice or estimates provided via the platform are for informational purposes only.
  • Sell My Home LLC may display advertisements or content from third parties; inclusion does not imply endorsement.
